The death sentence for Boston marathon bomber Dzhokhar Tsarnaev, has been overturned by a US Appeals Court. Tsarnaev had appealed his sentence in December, citing a jury bias. The younger of two brothers was convicted for the 2013 bombing at the Boston Marathon.

The trial took place in Boston, where the bombing occured, leaving the 26-year-old’s trial lawyer, Daniel Habib, to argue that the trial could not have been fair due to the high profile nature of the case.

The 1st US Circuit Court of Appeals in Boston has agreed and overturned the death sentence handed down to Tsarnaev.

This is a breaking story and will be updated as new details emerge.
