Are Immigrants Voting Part 2

(Spoiler alert, if the alien thinks they are a citizen, then they can vote without punishment. Citizenship is just a state of mind).

I was going through my social media feeds and ran into this clip of Marjorie Taylor Greene questioning traitor Alejandro Mayorkas:

While the headline focuses on the murder of Laken Riley (who cares about a dead white girl? Certainly not Mayorkas), the buried lede is that holier-than-thou profitable non-profits are encouraging illegal aliens to vote.

That’s so weird because I hear all these news reports that illegal aliens are not voting in federal elections. How could that be? After all, places like the AP would not lie to me. Why, they have their integrity on the line.

Take this headline from the AP, “Noncitizens voting isn’t an issue in federal elections, regardless of conspiracy theories. Here’s why” In the article, the AP concedes that some legal aliens have voted, but excuses it away by saying that the aliens thought they had a right to vote.

“To be clear, there have been cases of noncitizens casting ballots, but they are extremely rare. Those who have looked into these cases say they often involve legal immigrants who mistakenly believe they have the right to vote.”

The article makes mention of Trump appointing a commission to investigate aliens voting and that it “It disbanded without identifying a single case of a noncitizen casting a vote.” So there must not be any voter fraud and all aliens (legal or not) are incredibly honest, right? Not so fast, the Democrats and their allies are very skilled at going on the offense. Immigration patriot Kris Kobach (who served as vice chair) said of the commission when Trump dissolved it, “I fully back the president’s decision,” Kobach said in an interview. “There were almost a dozen lawsuits filed against the commission.” The Democrats and their open borders allies essentially shut down the commission through lawfare. They didn’t want the commission exposing the truth. The Democrats went so far as to refuse to condemn illegal aliens voting.

As previously reported, I know that green card holders and illegal aliens are voting in elections. There was the case of the Jamaican woman who registered to vote for the “Obama Party”. (If you read that article, keep in mind that former Mayor Richard Molina admitted he committed voter fraud, but got off by telling the all Hispanic jury that he thought what he was doing was legal. It’s called an affirmative defense).

The left likes to get in front of a problem and go on the attack to deflect blame. In this case, Hot Air has an article titled “AP tries to explain why non-citizen voting is no big deal”. I like the first commenter’s evaluation of the article, “Standard media spin re these things: First, it’s impossible. Then, well it’s possible, but it never happens. Then, well, it happens, but in very small amounts. Then, well, perhaps not that small, but certainly not enough to change the election results. And then: Shut up! You’re a racist!!!!”

Going back to the AP wire story that excused illegal aliens voting by saying that the “aliens thought they had a right to vote”, this is actually very important it turns out. Why? Because they want to make it hard to convict an aliens (legal or not) from being sentenced for having voted.

(c)Subsection (a) does not apply to an alien if—

(1) each natural parent of the alien (or, in the case of an adopted alien, each adoptive parent of the alien) is or was a citizen (whether by birth or naturalization);

(2) the alien permanently resided in the United States prior to attaining the age of 16; and

(3) the alien reasonably believed at the time of voting in violation of such subsection that he or she was a citizen of the United States.

One of the reasons that the 1986 Immigration Reform and Control Act was so ineffective (besides the amnesty) was because of one word; “knowingly”. It was supposed to punish employers who “knowingly” hired illegal aliens. How did that work in practice? It spawned a trade in counterfeit documents, and got illegal aliens to get driver’s licenses from states that allowed illegals to get them (even if the illegals didn’t really live in that state). Employers could claim (whether true or not) that they believed the illegal alien was actually legal because the illegal alien had given them a Social Security Card, or, presented them with a driver’s license. It helped make farm and ranch check actually more difficult, not less. Now, to get a conviction, the Border Patrol and I.N.S. (this was before D.H.S. Was formed) had to read the mind of the employer. Did he actually know the illegal alien was illegal?

You can see the logic of not wanting to punish someone who got duped, but then it opened the door for a whole different set of problems. It would have been better to just punish everyone who hired an illegal alien regardless of what their supposed state of mind was. This would have forced employers to go to immigration enforcement and ask if their prospective employee was legally in the country or not. It would have put the onus on the employer.

With the way 18 U.S.C. 611 is worded, it puts the burden back on the government to prove what the offender’s state of mind was at the time.
